A Georgia woman has filed a lawsuit against a fertility clinic after an embryo mix-up led her to carry and give birth to another couple’s biological child, leaving her emotionally devastated. Krystena Murray, 38, from Savannah, gave birth to a baby boy in December 2023, only to later learn that the child was not hers biologically. Despite forming a bond with the infant, she lost custody of him just five months later, a decision that left her heartbroken.
The lawsuit, filed on February 18, 2025, names Coastal Fertility Specialists, a clinic with locations in Savannah and South Carolina, as the defendant. The case also names Dr. Jeffrey Gray and several unknown individuals. Murray’s legal team claims the clinic’s mistake, which resulted in the wrong embryo being implanted into her uterus, has left her “emotionally broken.”
According to the lawsuit obtained by USA Today, Murray carried the child through pregnancy and gave birth to the other couple’s baby. Despite the clinic’s alleged error, she chose to raise the child and develop a maternal bond. However, her attorneys state that Murray was devastated when she lost custody of the baby, and she has not seen him since.
The emotional toll of the incident has been significant for Murray, who had hoped to keep the child despite the circumstances. Her legal team has expressed that she is deeply affected by the emotional and psychological trauma caused by the loss.
The lawsuit highlights the significant impact that mistakes in fertility treatments can have on parents, both legally and emotionally. It seeks compensation for the distress and suffering Murray has endured as a result of the mix-up.
